Identification Slip Carried by Mary Phagan in Her Pocketbook Causes Theory That the Victim Had Been Threatened With Violence.

Either threatened with death or warned by some dread premonition of an untimely end, Mary Phagan is believed by Solicitor Dorsey to have prepared for her tragic fate by writing the identification slip discovered hidden in a compartment of the metal pocketbook which she carried daily.

The slip was given the solicitor Wednesday morning by a reporter for The Constitution. The reporter also made an authorized statement of the source from which it was obtained. It was given him by J. W. Coleman, step-father of the girl victim.

The slip was written six days before the murder. Her parents have never known her to have possessed such an article. Its presence in her pocketbook is said by them to be as mysterious as her death. Mr. Dorsey values it highly.

Bases New Theory On the Slip.

On it he already has based a plausible theory. Members of his staff have been assigned to investigation of the motive which impelled the slain girl to strive so thoroughly, as she endeavored in the mysterious slip, to establish her identification in case of emergency. Continue Reading →

If Leo M. Frank is guilty of any connection with the murder of Mary Phagan, his actions in the Tower belie the time-honored theories of the greatest criminologists the world has ever produced, visitors to the prisoner declare.

Famous psychologists, working on the supposition that the great weight of guilt upon the mind of a murderer will, if given time, finally overbalance the calm exterior with which he faces his accusers, have made excellent use of what they have termed “silent treatment.”

Prisoners accused of horrible crimes have been thrown into cells and left to brood in the long hours of the night. Often a scream, ringing down the prison corridors, will tell the tale of their guilt. Cell keepers, rushing up, have found prisoners re-enacting their crimes, muttering the same words they used when they slew their victims and beating the air with their fists. In one celebrated case demonstrating this, the man beat his brains out against the bars before he could be rescued. His action, it was claimed afterward, was due to overpowering remorse following the realistic pantomime of the death scene in which he figured. Continue Reading →

Probably Will Not Reveal Presence in City as He Investigates Phagan Case.

Colonel Thomas B. Felder said Wednesday that Detective William J. Burns had not arrived, as yet, in New York from his European trip, but that as soon as he did he undoubtedly would start at once for Atlanta to work upon the Mary Phagan strangling mystery.

Colonel Felder is acquainted with the day and the hour on which the famous sleuth will reach this city, but for the purposes of the investigation he is withholding the information.

“There was no authority for the statement that Detective Burns would be in New York Tuesday,” said Colonel Felder. “The date of his arrival has been known in my office, but it had not been made public.”

“It is quite likely that the great detective will come quietly and unannounced into the city, make his investigation of the mystery and slip out before many persons are aware from their own knowledge that he has been working on the case.”

In Touch With Burns Agency.

Colonel Felder has been in constant touch with Raymond Burns, son of the detective, who is secretary and treasurer of the Burns Agency, and has offices in New York. The agency is being placed in possession of the important new developments in the mystery as rapidly as they occur. Mrs. J. W. Coleman, mother of little 14-year-old Mary Phagan, prostrated with grief for sixteen days following the tragic slaying of her child, took up her household duties Tuesday for the first time, resigned to the calamity that has befallen her home, and relying on the law to avenge the death of her child.

“It was such a beautiful morning,” said Mrs. Coleman to a Georgian reporter, “and I have been able to rest now for three nights, so I felt like doing my work again. My house has been in such a turmoil since this dreadful tragedy. I feel I am helpless and have resigned myself to the sad lot that has befallen us. All we can do is wait, and waiting is a hard task.

No Complaint of Police.

“Don’t misunderstand me, I am complaining about what the officers are doing. It is far better to go slow and be sure that we are doing right than to hurry and make a mistake. I believe that the police and the solicitor are doing everything they can to find the guilty man. They ought to do it; such a crime ought to be punished. But I do not want them to make a mistake.

“I heard that feeling was very strong last week, but I am glad that no hasty action was taken. It might have been all wrong, and I think I would have been grieved as much as anybody.

“We have made many inquiries among our friends and acquaintances and have not found one who saw Mary after 12 o’clock Saturday, when she went to the factory to get her pay. So much seems to depend on that point, and if anyone did see her, he certainly ought to tell about it. It does look like if Mary were on the streets Saturday afternoon, as many friends as we have, some of them would have seen her. We do not believe she ever left the factory.” Continue Reading →

The history of the baffling Phagan mystery, daily recorded, is briefly as follows:

Sunday April 26—Girl’s body found in basement of pencil factory. Newt Lee, negro night watchman, who made discovery, arrested. Arthur Mullinax, street car employee, also arrested. Both held on suspicion.

Monday—Leo M. Frank, factory superintendent, detained, but later released. J. M. Gantt, former bookkeeper of pencil concern and friend of dead girl, arrested in Marietta. Negro elevator boy also taken into custody. Pinkertons enter case.

Tuesday—Bloody shirt found at negro watchman’s home. Planted evidence theory advanced. Mary Phagan’s body buried. Sleuths announce they have evidence to convict. Frank confers with negro suspect.

Wednesday—Inquest begins. Newt Lee testifies. One hundred and fifty pencil factory employees summoned before coroner. George Epps, newsboy, tells of ride to uptown with Mary Phagan on her last trip.

The mystery surrounding the murder of Mary Phagan, the young factory girl who met a tragic and a terrible death in the heart of a city whose streets were thronged with holiday crowds, may add another chapter to Atlanta’s record of unsolved and unpunished crimes.

Can such things be? is asked. Can murder, red-handed, find a victim in the midst of a populous city when the sun is smiling in God’s skies of blue and where the protecting power of the law and the vengeance of justice are near, and the criminal go uncaught and the crime unpunished? History answers “Yes,” for Atlanta’s criminal annals show that there have been, ever since the city was a village, murder mysteries that remained unsolved, despite the tireless efforts of human ingenuity to bring the murderers to justice.

Murder Will Not Always Out.

That “murder will not always out” is shown by the tragedies that are here recited, for of tragedies that left unfulfilled the mandate of Jehovah, “who sheds man’s blood by man shall his blood be shed,” Atlanta has had its full quota. Nor is this city more flecked with the blood of unavenged victims than other communities. Ever since the first murder of the world, when only fratricide’s God knew of the crime, punishment has come alone from some power greater than that of man.

The stories here recorded of “Atlanta’s Murder Mysteries” had all the elements of boldness and brutality to defy the skill of Gaborian’s “LeCoq” or Conan Doyle’s “Sherlock Holmes.” Many clues were followed up and arrests were made.  In some of the cases the officers were positive they had caught the guilty criminals, as the evidence appeared convincing and conclusive, but in the end the mystery still remained a mystery. Mary Phagan is dead. She was murdered.

Leo Frank, and Newt Lee are in jail, upon the findings of a Coroner’s jury, held as suspects for investigation by the Grand Jury.

Here is a case of cause and effect involving the most elusive series of connecting events that ever came under my observation of criminals and crime, through fifteen years of varied newspaper experience in a number of American cities.

It is not my purpose here to try this case. Such comments as I may set down are personal merely.

I did sit through the last day of the Coroner’s inquest, but beyond that, my information as to this strange case came to me by way of the mouths and pens of persons charged with some measure of responsibility for fixing the truth of the matter in such wise as it might be fixed. My facts are authoritative, my conclusions strictly my own.

It is my opinion that the slayer of poor, little Mary Phagan has not yet been found or identified. Moreover within my mind there dwells an ever-increasing doubt that her slayer, or slayers, ever will be apprehended. Continue Reading →

HOW DETECTIVES THINK CRIME WAS COMMITTED

They Maintain That Mary Phagan Was Left Unconscious in Factory Near Midday and Killed Later in Afternoon

For the first time since the lifeless body of pretty fourteen-year-old Mary Phagan was found in the basement of the National Pencil factory, this morning two weeks ago, The Journal is enabled to make public the theory of the city detectives and others investigating the murder mystery as to how the crime was committed.

HERE IS THE THEORY.

The theory in detail is:

That Mary Phagan arrived at the pencil factory between 12 and 12:10 o’clock on Saturday, April 26; that within a short time after she arrived there she was lured to the metal room on the second floor, where she worked; that the big doors of this room were closed, making it almost impossible for the two men working on the fourth floor to hear any outcries; that she was overpowered and assaulted. New Evidence, Just Submitted to Detective Department, Leads Chief Lanford to Believe That Mary Phagan Was Murdered in the Basement — Woman Says She Heard Screams on Saturday Afternoon.

A new and important witness has been found in the Mary Phagan murder mystery.

She is Monteen Stover, a girl of 14 years, a former employee of the pencil factory.

After already having attested to an affidavit now in possession of the solicitor general, she will testify before the grand jury that on the day of Mary Phagan’s disappearance, she entered the pencil plant at 12:05 o’clock in the afternoon and found the office deserted.

Also, that she remained five minutes, during which time no one appeared. The building seemed empty of human occupants, she declares, and no sounds came from any part. Expecting to have found the superintendent, she says she went through both the outer and inner offices in search of Frank.

Testimony Important Declare Police.

The police say that this is valuable evidence because of the testimony of Frank at the inquest to the effect that he remained in his office throughout the time between 12 noon and the time at which Quinn arrived, 35 minutes after 12. Leo M. Frank general superintendent of the National Pencil factory, was recalled to the stand. He was questioned regarding the elevator. The coroner wanted to know what kind of a door there is to the shaft on the office floor. The witness replied that it is a heavy door solid, that slides up and down.

“Where was the elevator on Saturday, April 26?” he was asked.

“I didn’t notice.”

“Where was it on Friday night?”

“I didn’t notice.”

“Was the door open on Saturday?”

“I didn’t notice.”

Asked whether it would not be possible for some one to fall into the elevator shaft if the door was open, he replied that there is a bar across the door.

“Where was the elevator after the murder?”

“I can only say it was at the office floor on Sunday morning,” replied the witness.

Sensational Statements Made at Inquest by Two Women, One of Whom Had Been an Employee, Who Declared That Frank Had Been Guilty of Improper Conduct Toward His Feminine Employees and Had Made Proposals to Them in the Factory.

EVIDENCE IN BAFFLING MYSTERY THUS FAR, IS CIRCUMSTANTIAL, IS ADMISSION MADE BY DETECTIVES

Frank and Lee Both Go on Stand Again and Are Closely Questioned in Regard to New Lines of Evidence and Forced to Reiterate Testimony Formerly Made to Coroner’s Jury. They Will Remain in Jail Pending Action of the Grand Jury.

Leo. M. Frank, superintendent of the National Pencil factory, and Newt Lee, the negro night watchman, suspects in the Mary Phagan murder, were ordered by the coroner’s jury to be held under charges of murder for further investigation by the Fulton grand jury.

With this verdict the inquest closed at 6:28 o’clock yesterday afternoon. Frank and the negro will be held in the Tower until action is taken by the grand jury and solicitor general. The decision was reached within twenty minutes after the jury had retired.

Although much important testimony was delivered at the inquest, probably the most significant was the admission made by Detective Harry Scott, of the Pinkertons, and Detective John Black, of headquarters, both of whom declared in answer to questions that they so far had obtained no conclusive evidence or clues in the baffling mystery, and that their only success had been attained in the forging of a chain of circumstantial evidence. The coroner’s charge to the jury was in part as follows: “You have heard the statement of the county physician. You have seen what caused death. You have seen the body and have heard the evidence in the case.

“It is your duty to inquire diligently as to how Mary Phagan came to her death. That was your oath. In case of unnatural death, you were to determine at whose hands death came.

“You have heard the county physician say strangulation caused death. In determining who is guilty of the murder you turn to the evidence, and if you find that any other party is implicated or is attempting to shield the murderer, he is guilty in the same degree.

“Your position in this matter is similar to that of a commitment court, not a trial court.

“If there is a reasonable suspicion in your mind directed against any person or persons in connection with this crime, it is your duty to hold them. You can also hold witnesses who are essential in trying this case. If you think anybody not actually connected with the case has important information bearing upon it, you can hold them.

“If you believe any one is concealing information, it is your duty to commit that person as an accessory of the crime.”

Miss Daisy Jones Convinces Jury She Was Mistaken for Mary Phagan

Miss Daisy Jones, identified by J. L. Watkins as the girl whom he had mistaken for Mary Phagan on the afternoon of April 26, appeared before the coroner’s jury dressed exactly as she was on that afternoon, and testified that she had been just where Watkins said he saw Mary Phagan at the hour when Watkins thought he saw the girl, and that she had crossed a vacant field just as Watkins described Mary Phagan as having done.

In short, with Mr. Watkins’ new testimony, she proved conclusively that it was not Mary Phagan who was seen that afternoon there, but heself—the witness.

She lives at 251 Fox street, said the witness. She is fifteen years old. Her home is on the corner of Fox and Lindsay streets, one block from Mary Phagan’s home. Between 5 and 6 o’clock on the afternoon of Saturday, April 26, said she, she carried her father’s supper to him in his store at the corner of Bellwood avenue and Ashby street. She went back home along Bellwood avenue and crossed a vacant field before she reached Lindsay street, passing between two trees in that field.

She was acquainted with Mary Phagan, said the witness. They were about the same size, said she, though Mary was a little heavier and not quite so tall. Their hair was about the same color, she said.

On the afternoon of April 26, said she, she was dressed exactly as she appeared there at the inquest—in a blue serge skirt, white shirtwaist with a blue bow on the front of it, and a blue bow in her hair. The coroner asking her height, she was measured against a board in the detectives’ office and was found to be five feet one and a quarter inches tall.

Object to Flaring Headlines Over Phagan Mystery.

One hundred of the most prominent members of the Greek community in Atlanta gathered in their community hall on Whitehall street last night and protested vigorously against the use of the word Greek in an afternoon paper in connection with the Phagan mystery.

The article in question stated that the Pinkertons had said that the murder of Mary Phagan was done in the Mediterranean style and that a certain Greek restaurant employee was being shadowed or words to that effect.

“We protest must vigorously against such use of the word Greek in flaring headlines,” said D. Vafiadis, Greek consul. Before any arrest of a Greek is made flaring headlines in an extra call the city’s attention to the Greek race.

“There is no style in crime that we know of. Each murderer has a style of his own. I never heard of a Mediterranean style until tonight when I read a sensational extra.”

“If a Greek had committed this crime he would never get out of Atlanta alive,” said G. Algers, president of the Greek community. “The Greeks would have lynched him, and we protest most vigorously against such treatment as we received today in the newspapers. We are industrious and law-abiding and the majority of us are prominent property holders in Atlanta. We do not wish to have the public turned against us. If a Greek should ever be arrested, say Mr. Petros as you would say Mr. Smith.”

Pinkertons Find No Foundation for Report of Lunch Room Helper’s Disappearance.

Harry Scott, of the Pinkertons, said Thursday that the information obtained by his agency to the effect that a Greek helper in a restaurant had disappeared following the killing of Mary Phagan had proved baseless so far as he was able to determine.

“It was a blind clew,” he said. “We were unable to find that any one was missing from the restaurant. Neither were we able to locate the supposedly missing person in Anniston, Ala., where our information said he was.”

In discussing the alleged mysterious disappearance of one of his employees shortly after the discovery of the murder of little Mary Phagan, this morning, George Pappas, proprietor of the Busy Bee Café at Hunter and Forsyth Streets, said that there was no basis for any rumor involving anybody in his place.

“There was no one working in the restaurant at the time of the murder except my brother, Stamates Pappas, and myself, and, as you can see, we are both still here,” he said. Continue Reading →

Late this afternoon the police and detectives engaged on the Phagan case said they were satisfied with the progress being made before the Coroner’s Jury.

Apparently all other clews have been abandoned, and the present line of police activity would seem to center around Lee and Frank.

Whatever evidence the police have they refuse to disclose.

The entire mystery will be taken up by the Grand Jury within the next few days.

Man Who Said Mary Phagan Passed His Place Testifies He Was Wrong.

J. L. Watkins, who testified that he saw Mary Phagan Saturday afternoon, April 26, between 4 and 5 o’clock, was called to the witness stand.

He was accompanied to the inquest by a girl, Daisy Brown, who he said was the girl he mistook for Mary Phagan.

He said he became convinced of his mistake when detectives came out to his place and had Daisy Brown to dress as she was Saturday afternoon. Then he discovered, he said, that she was the girl he had mistaken for Mary Phagan.

Daisy Brown was placed on the stand and testified that she had passed along Bellwood Avenue at that time, Saturday, April 26.

She said she knew Mary Phagan, but could not understand how Watkins had mistaken her for Mary Phagan, as Mary was a little shorter and heavier.

J. L. Watkins, called to the stand after Miss Hall, the stenographer, was excused, clarified his former testimony that he had seen Mary Phagan on the street near her home on Saturday afternoon, April 26, by declaring that he is convinced now he was mistaken about it.

“Mr. White [sic], on last Thursday did you not swear before this inquest that between 4 and 5 o’clock on the afternoon of Saturday, April 26, you saw Mary Phagan walking along Bellwood avenue toward her home?” asked the coroner.

“Yes, that’s so,” answered the witness. “I was honestly mistaken.”

He was asked how he had found out that he was mistaken. He replied that Detectives Starnes and Campbell had found the young woman whom he mistook for Mary Phagan. He is absolutely certain now that he was mistaken, said he. They had brought the girl before him, dressed in the same clothes that she wore that afternoon, and had caused her to cross a vacant field just as she crossed it that afternoon.

The girl whom he mistook for Mary Phagan, said he, he knew now to be Daisy Jones. He pointed her out among those in the room.

He was excused from the stand.

Search for Finger Prints and New Wounds Is Reported Reason—Inquest Resumed Thursday—Strange Man Sought.

Mary Phagan’s body will be exhumed today for the second time. Bertillion and medical experts will make examinations for finger prints and wounds which may have been overlooked before. Coroner Donehoo and Dr. H. F. Harris, of the state board of health, will be in charge.

Between 9 and 10 o’clock is the scheduled time. The coroner and Dr. Harris and others of their staffs will leave at daybreak this morning in automobiles. They are expected to return about noon. The examination will be at the grave side.

This action is taken at the request of Solicitor General Hugh M. Dorsey. Neither he nor Dr. Harris would talk when questioned by a Constitution reporter last night. Although they admitted that a second exhumation was in view, they would not divulge their reason. Continue Reading →

Former Atlantan, Who Was Taken Into Custody in Houston, Texas, Early on Monday Night, Released After an Investigation by Chief of Police Department, Who Says He Is Convinced of His Innocence.

BOWEN WAS IN CHINERO ON DAY OF THE MURDER HE TELLS DETECTIVES

His Father, Cal Bowen, of Newnan, Ga., Received a Message Last Night From His Son, Declaring That He Had Been Fired — Bowen Is Well Connected in Georgia and His Friends Are Indignant Over His Arrest.

Paul P. Bowen, former Atlantan, who was arrested in Houston, Texas, Monday night on suspicion of being connected with the Phagan murder mystery, as told in The Constitution extra Tuesday morning, was released from custody last night, and declare guiltless by the police chief of that city.

George Peyton, chief of the detective force, who led the arresting party, has been discharged as a result of the arrest, on the ground that he “exceeded his authority” in taking Bowen into custody. Continue Reading →
